Conditions of sale and delivery

For all deliveries by Wetrok AG (hereinafter "Wetrok") to customers, the following general terms and conditions of sale and delivery shall apply, unless special agreements have been made between the parties (sale and delivery in principle only to professional users). Amendments to these terms and conditions require written confirmation by Wetrok. The disclaimer published on the website is an integral part of these GTC.

Conclusion of contract

The contract between Wetrok and the customer shall only come into existence through an order of the customer and its acceptance by Wetrok. The customer's order is placed by telephone, in writing, by fax, online shop or e-mail. Wetrok accepts the order by delivering the ordered goods (incl. delivery note) or by sending an order confirmation (by fax, e-mail or letter post) at the customer's request.

Prices

All prices are quoted in CHF excluding value added tax (VAT) and are based on the current price list. The prices in the online shop are considered an offer. However, this offer is always subject to the condition that the contract is terminated by an incorrect price indication. The value added tax is shown separately on the invoice. The prices are kept as stable as possible, but can be adjusted upwards or downwards according to the market situation. Our customer service will be happy to provide you with information on current prices at any time or will issue you with an offer with current prices. For individual chemical-technical products, the VOC levy (VOC for volatile organic compounds) is also levied in accordance with statutory regulations. The VOC levy is shown separately on the invoice. Empty containers will be taken back at the customer's request at the customer's expense. For single batteries, the VEG-levy (VEG for early disposal fee) is additionally charged according to legal regulations. The VEG charge is shown separately on the invoice.

Delivery dates

If Wetrok is unable to meet the agreed dates or deadlines, it shall inform the customer accordingly. The customer undertakes to grant Wetrok a reasonable grace period and expressly waives any damage caused by default.

Delivery costs/order processing

For orders with a value of goods from CHF 350.00 net (excl. VAT and VOC duties), delivery is free domicile. For orders with a goods value of less than CHF 350.00, a processing fee of CHF 28.00 will be charged. Surcharges for express deliveries shall be borne by the customer.

Ownership and risk

Ownership and risk in the Wetrok products shall pass to the customer at the time when the products are actually handed over to the customer or his representative by the forwarding agent at the specified delivery address.

Warranty/notification period

The customer is obliged to check immediately upon receipt of the goods whether the delivery corresponds to his order. Deviations must be reported immediately.

Returns

Return of incorrectly ordered goods will only be accepted with a delivery note/billing document. Returns must be made within 10 days of the delivery note date by calling the following telephone number 0848 81 81 81, otherwise the delivery shall be deemed accepted. Subsequently, the reported return must be returned within 30 days of the delivery note date. Returns will no longer be accepted after this period has expired. This warranty applies exclusively to new/unused materials. Opened containers and torn packaging will not be taken back and will not be refunded. A lump sum of CHF 90.00 will be charged for collection by Wetrok. For incorrectly ordered goods, Wetrok reserves the right to pass on the real costs to the client.

Payment

30 days net, no discount. Unauthorised cash discount deductions will be charged subsequently. The default interest from the due date is 6 %. From the 2nd reminder onwards, reminder charges of
CHF 30.00 will be charged. For cash purchases at our points of sale, a cash discount of 2 % is granted.

Repair and maintenance

Repair and maintenance work are carried out by the regional Wetrok service technicians on site or in the service workshop.

Wetrok is ISO 9001 certified.

Environmental management

Wetrok is certified according to ISO 14001.

Eduqua

The Wetrok Academy is Eduqua certified.

Model and design changes

Model and construction changes as well as resulting price changes are reserved at any time.

Chemical-Technical Products (CTP)/Product Safety and Storage

 Information Hazard warnings and safety advice can be found in the relevant safety data sheet. These can be viewed on our homepage at www.wetrok.com(PDF files) or under the telephone number 0848 81 81 81 81 can be ordered. Wetrok products are intended for professional users/specialists. They must be stored in closed original containers. The CTP must be protected from frost, heat and light.

Applicable law and place of jurisdiction

Swiss law applies exclusively to Wetrok's deliveries. The Vienna Sales Convention of 11 April 1980 shall not apply. Both parties acknowledge the exclusive jurisdiction of the ordinary court in Zurich for all disputes arising out of or in connection with Wetrok's deliveries.
